Adashi Systems LLC (hereinafter “Adashi”) has enhanced its Privacy Policy to comply with new data regulations including the European Union General Data Protection Regulation (GDPR). We believe that GDPR establishes the current gold standard for defining policies and procedures relating to the acquisition, use, and security of data. Accordingly, we are using this standard for dealing with all data, both inside and outside the European Union.  Simply stated, we are continually committed to protecting your personal data and handling it responsibly.

General Information

Adashi Systems (hereinafter “Adashi”) respects the trust you place in us to appropriately to collect and process your data including the personal information of you and your end users. This Privacy Policy explains how Adashi collects and uses personal information collected from you, through:

(i) our publicly available websites,

(ii) Adashi products, including Adashi RollCall, Adashi C&C, Adashi LiveView, Adashi First Response MDT, and other related applications and services (together the “Services”),

(iii) third parties and

(iv) interactions you have with our employees or affiliates.

Website Information

This Privacy Policy covers the information practices of our websites, including how Adashi collects, uses, shares, and secures the personal information you provide. Personal data is any data about an identified or identifiable natural person, or any information that in combination with other non-personal information can reasonably be used to identify a natural person. Data Collection

The type of information we collect from you depends upon the type of interactions you have with our websites and Services, including the context of your interactions with Adashi, the choices you make (including privacy settings), as well as the Services you use.

You may choose to give us personal information directly in a variety of situations including if you request to receive information or a service from Adashi, if you apply for a job via our website, or if you do business with us as a supplier or partner.

We may also collect information relating to your use of our websites and our Services through the use of various technologies. For example, when you visit our websites, we may log certain information that your browser sends, such as your IP address, browser type and language, access time, and referring web site addresses. Why Data is Required

Data Processing

If you choose to provide us with information including personal data, you understand that we are storing this and/or transferring it to Adashi locations and systems in the United States or to the locations and systems of Adashi affiliates or service providers around the world. Adashi complies with applicable law when transferring your personal information.  Adashi uses a variety of data transfer mechanisms including standard contractual clauses for this purpose.

Data Storage

Adashi stores personal data no longer than (a) the duration required to satisfy the purposes for which the personal data is processed, (b) if processing is pursuant to consent, until you withdraw your consent, or (c) if processing is pursuant to a legitimate interest of Adashi, until you object to such processing.  Still, we will store personal data for a longer period where (a) we are required by law or (b) your personal data is required for Adashi to assert or defend a legal claim. In this event, we will store your personal data until the end of the relevant retention period or until the claims in question have been settled.

Data Rights

You can make a variety of choices related to your personal data.  Your data can be accessed, corrected, or deleted.  You can also update your choices concerning how that data is used. Any choices you do make will be subject to existing statutory regulations or other prevailing legal rights held by Adashi. If you request that personal data required for the use of Adashi Services be deleted, your ability to continue use of those Services will terminate.  You also may restrict the use of personal data until i) material that you claim is incorrect is evaluated for accuracy and any necessary correction or ii) there is no legal basis for Adashi to process your data but you do not want Adashi to delete it.

If Adashi uses your personal data pursuant to consent or to perform a contract with you, you may request from Adashi a copy of the personal data in a portable format that you have provided to Adashi. Please send any such requests to dataprivacy@adashi.com.

Right to File a Complaint

Use of Website by Children

Adashi recognizes the privacy interests of children and we encourage parents and guardians to take an active role in their children’s online activities. Adashi websites are not intended for children under the age of 16 and Adashi does not target our websites to children under 16.  Adashi policy is to not knowingly collect personal data from children under the age of 16.

Data Processing Rights

Adashi and its Services are subject to the laws of the United States and other countries including but not limited to Australia and those in the European Union.  Accordingly, Adashi is required to take measures with regard to the processing of personal data that are consistently in compliance with these laws.

If you request information on our Services, order our Services or become our business partner, we typically ask you to provide your personal contact information such as name, business email address, business telephone number, company name and address, job title, role and, if payment is to be made to Adashi, financial and billing information, such as billing name and address, tax identification number, credit card information, bank details, or other payment information. We use the personal data only to process your order or to provide the requested Service.

If you participate in tutorials and trainings or use learning tools provided by Adashi, we may ask you about your professional qualifications, relevant experience and education. Adashi may also track your learning progress in these activities.

If you communicate with us on a regular basis as part of a relevant business relationship you may not be able to opt out of these communications which are not marketing related.

With regard to marketing-related communications Adashi will (i) if legally required, provide you with such communications after you have opted in, and (ii) provide you the opportunity to opt out if you do not want to receive further marketing-related communication from us.

Adashi processes your personal data based on an Adashi legitimate interest in the following ways:

i)  Adashi may invite you to participate in questionnaires and surveys which are generally designed in a way that they can be answered without any personal data. If you nonetheless enter personal data in a questionnaire or survey, Adashi may use such personal data to improve its Services.

ii) Adashi may, in the course of providing services to you, collect, use, process, and store usage data such as number of sessions, users, number of sessions, number of users, page views, number of page views per sessions, average session duration, bounce rate, percentage of new sessions, language of user, country, city, new versus returning users, browser type, operating system, internet service provider, IP address, screen resolution size, Service used, Service version number and mobile device brand. The usage data is collected and processed in order to:

a) maintain and improve the performance and integrity of our Services, (b) understand which Services are most commonly deployed and preferred by customers and how customers interact with our Services, (c) identify the types of Services that may require additional maintenance or support, and (d) comply with regulatory, legislative and/or contractual requirements.

iii) If Adashi has existing business with you, we may inform you about our products or services (including webinars, seminars, or events) which are similar or relate to such products and services you have already purchased.

iv) If Adashi is acquired by or merges with another entity, if all or part of our assets are acquired, or pursuant to operation of law, we may transfer your information to the succeeding entity for purposes that are similar to those for which it was originally acquired.

v) If Adashi receives business contact details from prospective customers, we may enter this data into an Adashi customer relation management system.

vi) If Adashi receives business contact details from third party business partners regarding prospective customers who have expressed an interest in finding out more about Adashi, we may enter this data into an Adashi customer relation management system. Additionally, we may use this data in responding to your requests.

vii) If Adashi receives personal data from third parties that have a business relationship with us such as marketing companies, advertising companies, or organizers of events, such data may be used in evaluating a potential business relationship with you or for combining the information with personal data that we may have already collected about you.

You may object to Adashi using your personal data for the purposes set forth in this section at any time by sending your request to dataprivacy@adashi.com.  If you do so, Adashi will cease using your personal data for such purposes and remove it from its systems unless Adashi is permitted to use such personal data for another purpose set out in this Privacy Policy or Adashi determines and demonstrates a compelling legitimate interest to continue processing your personal data.

Adashi processes your personal data based on your consent in the following ways:

  1. Where you have given your consent, Adashi may use your name, email address, telephone number, job title and basic information about your employer (name, address, and industry) for the purpose of keeping you current on the latest product announcements, software updates, software upgrades, special offers, and other information about Adashi Services and events (including marketing-related newsletters).
  2. If you register for an Adashi event, seminar, or webinar, we may share basic participant information (typically your name, company, title, and email address) with other participants of the same event, seminar, or webinar for the purpose of communication and the exchange of ideas with your consent. We may also ask you to consent to sharing your participant information with sponsors of that event. Additionally, we may ask for information about special dietary requirements or other health/impairment information in connection with the registration for and provision of access to an event or seminar. Any such information is voluntary.
  3. If you apply for a job via our website or otherwise, we may require you to submit additional personal information as well as a resume or curriculum vitae and other information. We encourage you to limit the personal data to the information necessary to enable us to evaluate your suitability for the position you are applying for.
  4. If you choose to participate in blogs, forums, and social media networks offered by Adashi, you may be required to register and create a user profile. User profiles provide the option to display personal information about you to other users, including but not limited to your name, photo, social media accounts, postal address, email address, telephone number, personal interests, skills, and basic information about your company. All of the information that you post will be available to all visitors to our websites.

You may at any time object to, opt out, and withdraw a consent granted hereunder by e-mailing dataprivacy@adashi.com.

In case of withdrawal, Adashi will cease processing the relevant personal data which was based on consent unless we have legal justification to reject the withdrawal. In case Adashi is required to retain your personal data for legal reasons, your personal data will be restricted from further processing and retained for the term required by law. Please note that any withdrawal has no effect on past processing of personal data up to the point in time of your withdrawal. Furthermore, if use of our Services requires your consent, Adashi will no longer be able to provide the Services to you.
